LCS Działdowo contract settled
Trakcja PRKiI S.A., acting as the leader of the Consortium of contractors performing modernisation work on a 58-kilometre section of the Warsaw-Gdynia railway line between Mława and Montów, composed of:
1. Trakcja PRKiI S.A.,
2. ZUE S.A.,
3. Przedsiębiorstwo Napraw i Utrzymania Infrastruktury Kolejowej w Krakowie Sp. z o.o.,
4. Ing. Jiří Hanák, insolvenční správce (trustee in bankruptcy) for EIFFAGE CONSTRUCTION CESKA REPUBLIKA, s.r.o.,
5. Zakład Robót Komunikacyjnych DOM w Poznaniu Sp. z o.o.
carried out negotiation and concluded with the Purchaser a pre-trial amicable settlement, under which the Purchaser agreed to pay the Consortium the amount of PLN 15,740,228.58.
In addition, apart from the amicable settlement concluded, the Purchaser agreed to pay the Consortium PLN 7,259,771.42 to cover the cost of performing the Contract for an extended term. As part of the Final Account of the Contract, as regards the remuneration for the work performed in previous periods during the term of the Contract, the Contract Engineer has recognised the gross amount of PLN 17,997, 919.06 that the Purchaser agreed to pay to the Consortium.

By using available amicable dispute resolution instruments we managed to avoid lengthy and costly trial proceedings. „Under the pre-trial amicable settlement, PKP Polskie Linie Kolejowe S.A. has recognised the costs that arose during the extended term necessary for the performance of the Agreement. In our opinion, both the manner of negotiation and the arrangement achieved are of exemplary nature and may serve as a model solution for similar cases arising out between a purchaser and contractor.” – adds Roman Przybył.
