14/2016 - Material Agreements - Supplement

The Management Board of Trakcja PRKiI S.A. (the "Company"), in reference to Current Report No. 43/2015, hereby announces that today, the Company:

1) acting as the consortium leader, signed with Przedsiębiorstwo Usług Technicznych INTERCOR sp. z o.o. based in Zawiercie (acting as a partner of the consortium) an amendment to the consortium agreement, which had been concluded for the purpose of seeking the award of a public contract for the "Design and construction of the S-5 expressway on the section Nowe Marzy-Bydgoszcz-Kuyavia and Pomerania border with Wielkopolskie Province. Part 4 – Design and construction of the S-5 expressway on the section from the Szubin junction (inclusive of the junction) to the Jaroszewo junction (inclusive of the junction) with the length of approx. 19.3 km” ("Amendment 1"), and

2) acting as a consortium partner, signed with Przedsiębiorstwo Usług Technicznych INTERCOR sp. z o.o. z based in Zawiercie (acting as the Leader of the consortium) an amendment to the consortium agreement, which had been concluded for the purpose of seeking the award of a public contract for the Design and construction of the S-5 expressway on the section Nowe Marzy-Bydgoszcz-Kuyavia and Pomerania border with Wielkopolskie Province. Part 1 – Design and construction of the S-5 expressway on the section from the Aleksandrowo junction (inclusive of the junction) to the Tryszczyn junction (inclusive of the junction) with the length of approx. 14.7 km” ("Amendment 2").

 

In Current Report No. 43/2015, the Company announced that the consortia composed of: Trakcja PRKiI S.A. and Przedsiębiorstwo Usług Technicznych INTERCOR sp. z o.o. based in Zawiercie entered into agreements for the performance of both public contracts.

Under Amendment 1, a new percentage share in the performance and value of the contract as part of the consortium has been agreed as follows:

Trakcja PRKiI S.A. based in Warsaw – 100 %, 

Przedsiębiorstwo Usług Technicznych INTERCOR sp. z o.o. based in Zawiercie – 0 %.

The net value of the contract is: PLN 286,155,940 (say: two hundred and eighty-six million, one hundred and fifty-five thousand, nine hundred and forty zloty).

The gross value of the contract is: PLN 351,971,806.20 (say: three hundred and fifty-one million, nine hundred and seventy-one thousand, eight hundred and six zloty, 20/100).

Under Amendment 2, a new percentage share in the performance of the contract as part of the consortium has been agreed as follows:

Przedsiębiorstwo Usług Technicznych INTERCOR sp. z o.o. based in Zawiercie – 100 %,

Trakcja PRKiI S.A. based in Warsaw (as a consortium partner) – 0 %,

The net value of the contract is: PLN 300,000,000 (say: three hundred million zloty).

The gross value of the contract is: PLN 369,000,000.00 (say: three hundred and sixty-nine million zloty).

 

Legal basis:

Section 5 paragraph 1 subparagraph 3 of the Regulation of the Minister of Finance of 19 February 2009 on current and periodic information published by issuers of securities and conditions for recognizing information required by laws of non-member states as equivalent.
