44/2015 - Information on conclusion of an amendment to material agreement

The Management Board of Trakcja PRKiI S.A. (the "Company", "Issuer"), in reference to Current Report No. 34/2011, hereby informs about mutual signing, by the Consortium composed as follows:

1. Trakcja PRKiI S.A. in Warsaw (Consortium Leader),

2. PKP Energetyka S.A. in Warsaw (Consortium Partner),

3. Przedsiębiorstwo Napraw Infrastruktury sp. z o.o. w upadłości likwidacyjnej (Consortium Partner),

4. Dolnośląskie Przedsiębiorstwo Napraw Infrastruktury Komunikacyjnej "DOLKOM" Sp. z o.o. in Wrocław (Consortium Partner),

with

PKP Polskie Linie Kolejowe S.A. in Warsaw, of an Amendment ("the Amendment") to the material agreement on "basic, line construction works at the section Wrocław – Grabiszyn – Skokowa and Żmigród – border of Dolnośląskie Province” as part of the Operational Programme Infrastructure and Environment's project 7.1 - 4 "Modernization of railway Line E 59 at the section Wrocław – Poznań, Stage II – section Wrocław – border of Dolnośląskie Province" ("the Agreement"), entered into on 24 May 2011.

Detailed information on the Agreement, including information on its value, was provided by the Company in the current report no. 34/2011 dated 25.05.2011.

According to the amendment to the Agreement we informed about in Current Report no. 19/2014 dated 2 July 2014, the Parties had agreed the date of work completion as 16 October 2015.

Under the Amendment referred to herein, due to circumstances attributable to PKP Polskie Linie Kolejowe S.A. in Warsaw, the Parties changed the work completion date and agreed that the work would be completed on 21 December 2015 at the latest.

Other provisions of the Agreement remain unaffected.

The criterion to deem the Agreement a material agreement is the fact that its value exceeds 10% of Company's equity.

 

Legal basis:

Section 5 paragraph 1 subparagraph 3 of the Regulation of the Minister of Finance of 19 February 2009 on current and periodic information published by issuers of securities and conditions for recognizing information required by laws of non-member states as equivalent.
