6/2015 Information on the filing of the petition for arbitration - update

The Management Board of Trakcja PRKiI S.A. ("Company") with reference to Current Report no. 61/2013 and Contentious Issues as disclosed in the financial statement of the Company for the 3rd quarter of 2014 hereby informs that PKP Polskie Linie Kolejowe S.A. ("Ordering Party") and Konsorcjum Trakcja Polska ("Consortium") settled the Agreement concluded on 31 May 2010 with respect to the performance of construction works of the comprehensive modernisation of rail station and route in the area LCS Działdowo under OPI&E 7.1-41: "Modernisation of railway line E-65/C-E 65 in the section Warsaw - Gdynia - LCS Działdowo" ("Contract"), whose the most important part is the Agreement reached with respect to the settlement of mutual claims.

 

Trakcja PRKiI S.A. acting as the Consortium leader composed of:

  1. Trakcja PRKiI S.A.,
  2. ZUE S.A.,
  3. Przedsiębiorstwo Napraw i Utrzymania Infrastruktury Kolejowej w Krakowie Sp. z o.o.,
  4. Ing. Jiří Hanák, insolvenèní správce (trustee in bankruptcy) EIFFAGE CONSTRUCTION CESKA REPUBLIKA, s.r.o.,
  5. Zakład Robót Komunikacyjnych DOM w Poznaniu Sp. z o.o.

negotiated and reached the pre-court Agreement with the Ordering Party, on the basis of which the Ordering Party is obliged to pay for the benefit of the Consortium the amount of PLN 15,740,228.58 (say: fifteen million seven hundred forty thousand two hundred twenty-eight and 58/100).

 

Additionally, regardless of the Agreement, the Ordering Party undertakes to pay the Consortium the amount of
PLN 7,259,771.42 (say: seven million two hundred fifty-nine thousand seven hundred seventy-one and 42/100) to cover the costs of performing the Contract in the extended period of time.

 

As part of the Contract Final Payment, in connection with the remuneration for the construction works carried out in the previous periods during the term of the Contract, the Contract Engineer accepted the gross amount of PLN 17,997,919.06 (say: seventeen million nine hundred ninety-seven thousand nine hundred nineteen and 06/100), which the Ordering Party undertook to pay for the benefit of the Consortium.

 

Legal basis:

§ 5, par. 1 point 8 of the Ordinance of the Minister of Finance of 19 February 2009 on current and periodic information published by issuers of securities and conditions for recognising as equivalent information required by the laws of a non-member state.
