58/2012 - Information on the statement by Przedsiębiorstwo Napraw Infrastruktury Sp. z o.o.

With reference to current report no. 49/2012 of 13 September 2012, the Management Board of Trakcja - Tiltra S.A. ("Company") informs that on 28 September 2012 the Company received from Przedsiębiorstwo Napraw Infrastruktury Sp. z o.o. ("PNI") a document with the information that PNI shall withdraw from the master agreement executed by the Company on 22 September 2011 with "PNI" ("Agreement"), from which the Company shall first withdraw on 12 September 2012. The Company deems the statement of PNI to be groundless and ineffective,  and the argumentation contained in the document to be inconsistent with the facts and legal status. According to the Management of the Company, the only valid withdrawal from the Agreement shall be the Company's withdrawal dated 12 September 2012 r.

Legal basis: Article 56 sec. 1 point 1 of the Act of 29 July 2005 on Public Offering, Conditions Governing the Introduction of Financial Instruments to Organised Trading and Public Companies (Journal of Laws No. 184, item 1439, as amended).
