2/2012 - Information on initiation of the enforcement proceedings against the Issuer?s subsidiary

The Management Board of Trakcja - Tiltra S.A. (the “Company”) hereby announces that today it became aware about initiation ??by the Court Enforcement Officer c/o the District Court for Warsaw - Mokotów of the enforcement proceedings against Poldim S.A., with its registered office in Tarnow (“Poldim”) – the Issuer’s subsidiary. 

The enforcement proceedings against Poldim were initiated according to the Order of the District Court in Tarnow, dated 28 January 2011, under the Banking Enforcement Document of Raiffeisen Bank Polska S.A., with its registered office in Warsaw (the “Bank”).

The enforcement proceedings shall cover:

The principal in the amount of PLN 17,274, 665.14

The interest accrued until 03.01.2012, in the amount of PLN 26,664.90

Further interest, in the case of delay, to be accrued from 04.01.2012, in the amount of PLN 6,597.50 per day.

In connection with the below claims,? the Enforcement Officer effected a seizure of the Poldim’s funds invested in DnB NORD Nord Polska S.A. bank, with its registered office in Warsaw, in the entire amount to be enforced. The above claims of the Bank have been paid.
