39/2010 - Information on an annex to a significant contract described in current report no. 26 of 20 August 2010

The Management Board of Trakcja Polska S.A. (“Company”) hereby announces that, an annex to the Execution Agreement of 20 August 2010 concluded by and between the Company and ZUE S.A., with its registered office in Krakow, about which the Company reported in current report no. 26/2010 of 20 August 2010 (“Agreement”), was signed on 30 November 2010.

Under the concluded annex, the parties agreed that:

The net Agreement value is:PLN 19,382,847.62 (nineteen million, three hundred and eighty-two thousand eight hundred and forty-seven zlotys 62/100).

The Partner shall receive an advance at the gross amount of PLN 15,290,815.15 (fifteen million, two hundred and ninety thousand, eight hundred and fifteen zlotys 15/100).

Of the value of the advance mentioned above, the Partner undertakes to transfer the amount of PLN 12,926,107.74 (twelve million, nine hundred and twenty-six thousand, one hundred and seven zlotys 74/100) to Przedsiębiorstwo Robót Komunikacyjnych w Krakowie S.A., with its registered office in Krakow. The Partner is liable to the Company for the refund of the whole of the advance, i.e. the amount of PLN 15,290,815.15 (fifteen million, two hundred and ninety thousand, eight hundred and fifteen zlotys 15/100).

Legal grounds for the submission of the report:Para. 5(3) of the Regulation of the Minister of Finance of 19 February 2009 on current and regular information published by issuers of securities and the conditions for accepting information required by the provisions of the law of a state which is not a Member State as being equivalent.
