38/2010 - Information about the annex to the significant contract

The Management Board of Trakcja Polska S.A. (the „Company”) hereby informs that on 30 November 2010 an annex was executed to the agreement dated 18 November 2010 entered into among between the Company, Comsa S.A., the Lithuanian companies Tiltra Group AB and AB Kauno Tiltai and their shareholders, i.e. UAB NDX Energija, AB Invalda and individuals being minority shareholders.  The Company provided information on this agreement in current report no. 35 dated 18 November 2010 (the “Agreement”).

In the annex, the Parties agreed that the deadline for delivery and accepting the disclosure letters (i.e. a specification of information disclosed by a party which excludes liability of the disclosing party related to representations and warranties), previously communicated by the Company in current report no. 35, is postponed until 13 December 2010. 

In order to be fully effective the above annex requires approval of the general managers of UAB NDX Energija i AB Invalda.

The Agreement is classified as material if 10% of the Company’s equity is exceeded.

Legal grounds for submission of the report: paragraph 5 point 3 of the Minister of Finance of 19 February 2009 concerning current and periodical information submitted by issuers of securities and terms and conditions of treating as equivalent information required by the law of a non-member country.
