36/2009 - Information on the entry of a registered pledge on a subsidiary?s machines into the register of pledges

In reference to the Report No. 4/2009 dated 10 February 2009 on the conclusion of a material loan agreement by the Issuer’s subsidiary, i.e.Przedsiębiorstwo Robót Kolejowych i Inżynieryjnych S.A. (hereinafter: PRKiI) with its registered office in Wrocław, The Management Board of Trakcja Polska S.A. (hereinafter the “Company”) announces that the Company received information on 21 July 2009 on the entry of machines being the subject of loan financing, i.e. an RM 80-750 ballast cleaner and four MFS 100 material transporters, into the register of pledges held by the 7^th Commercial Department of the District Court in Wrocław.

The registered pledge constitutes the legal security on a loan of EUR 5,913,761 extended to PRKiI for the purchase of the machines.

Level of the registered pledge:EUR 10,000,000.  

Legal grounds: § 5(1)(1) of the Regulation of the Minister of Finance of 19 February 2009 on current and regular information published by issuers of securities and the conditions for accepting information required by the provisions of the law of a state which is not a Member State as being equivalent.
