34/2009 - The list of shareholders holding at least 5% of the total number of votesat the Ordinary General Meeting

The Management Board of Trakcja Polska S.A. (“Company”) hereby submits the list of shareholders holding at least 5% of the total number of votes at the Ordinary General Meeting, held on 24 June 2009 in Warsaw.

1. COMSA SA - 81 065 510 votes, representing 88,02%of the votes present at OGM and50,63% of the total number of votes.

2. ING OTWARTY FUNDUSZ EMERYTALNY - 11 031 315 votes, representing 11,98% of the votes present at OGM and6,89% of the total number of votes.

Legal grounds: Article 70 paragraph 3 of the Act on the public offering and the conditions for introducing financial instruments into an organised trading system and on listed companies.
